Six Procedures and Job Content of Central Environmental Protection Inspection

The central ecological environment protection inspection generally includes six procedures: inspection preparation, inspection entry, sinking inspection, inspection report, inspection feedback, and rectification implementation.

01 Inspector Preparation

The preparation work for inspection mainly includes five items:

One is to inquire with relevant departments and units of the Party Central Committee and the State Council about the situation and problem clues of the inspected objects;

Secondly, organize necessary investigations and assessments;

Thirdly, determine the candidates for the team leader and deputy team leader, form a central ecological environment protection inspection team, and carry out mobilization training;

Fourthly, formulate inspection work plans;

The fifth is to issue notices for the entry of inspectors and implement various preparations for the entry of inspectors.

The time for the central ecological environment protection inspection to be stationed is generally determined based on the specific inspection targets and tasks. According to the first and second rounds of central ecological environment protection inspections that have been carried out, it usually takes one month to arrive.

02 Inspector stationed

During the inspection period, the work mainly includes six aspects:

One is to listen to the work reports and relevant thematic reports of the inspected objects;

The second is to have individual conversations with the main leaders of the party and government, as well as other relevant officials of the inspected objects;

The third is to accept letters, visits, and reports from the people regarding ecological environment protection;

The fourth is to access and copy relevant documents, archives, meeting minutes and other materials;

Fifth, conduct visits and inquiries to relevant localities, departments, units, and individuals;

Sixth, investigations and evidence collection can be conducted based on problem clues, and relevant localities, departments, units, and individuals can also be instructed to provide written explanations on relevant issues.

During the inspection period, the inspection team can also hold symposiums and attend relevant meetings of the inspected objects.

03 Sinking Inspection

During the inspection period, the inspection team can also form several sub inspection teams to conduct sub inspections in the subordinate places, departments or units of the inspected objects, and request assistance from relevant places, departments, units and individuals. Each inspection team will develop and organize the implementation of the sinking inspection work plan based on actual conditions.

Submerged inspection is a key part of ecological environment protection inspection, which is carried out through inspection methods such as reviewing materials, visiting and discussing, conducting special inspections, and conducting on-site spot checks.

Each sinking inspection team mainly focuses on the key and difficult issues of ecological environment protection, adheres to problem orientation, focuses on prominent environmental problems that are highly concerned by the central government, strongly reflected by the masses, and have a negative social impact, and their rectification and handling situations. They adhere to on-site verification on the front line, do not hold mobilization meetings or listen to reports, and go straight to the county (district, city) to carry out on-site verification, and conduct on-site inspections in various streets, towns, industrial parks, and economic development zones.

Each sinking inspection team generally observes the scene during the day and meets at night to study the situation and make plans. They promptly transfer the discovered problem clues to local investigation and handling, and carry out specific inspection tasks in an orderly, effective and efficient manner, pushing the inspection work deeper.

In response to prominent issues discovered during inspections, relevant party and government leaders can also be interviewed or interviewed depending on the situation.

04 Inspection Report

After the inspection is completed, the inspection team shall form an inspection report within the prescribed time limit, truthfully report the important situations and problems discovered by the inspection, and put forward opinions and suggestions.

The inspection report shall be exchanged with the inspected object in an appropriate manner, reviewed by the Central Leading Group for Ecological Environment Protection Inspection, and submitted to the Party Central Committee and the State Council.

05 Inspector Feedback

After the inspection report is approved by the Party Central Committee and the State Council, the Central Ecological Environment Protection Inspection Group will provide feedback to the inspected objects, pointing out the problems found during the inspection and clarifying the requirements for rectification work. The inspection results serve as an important basis for the comprehensive assessment and evaluation of the leadership team and leading cadres of the inspected objects, as well as for rewards, punishments, appointments, and removals. They are sent to relevant organizational departments and personnel departments in accordance with the cadre management authority.

For important ecological and environmental problems and their dereliction of duty discovered during inspections, the inspection team shall form a list and case files of ecological and environmental damage liability investigation issues, and transfer them to the Central Commission for Discipline Inspection, the National Supervisory Commission, the Central Organization Department, the Party Committee of the State owned Assets Supervision and Administration Commission of the State Council, or the inspected objects in accordance with relevant authorities, procedures, and requirements.

If the inspection finds that it is necessary to carry out ecological environment damage compensation work, it shall be transferred to the provincial, autonomous region, or municipality government for compensation and recovery in accordance with relevant regulations; If a public interest lawsuit needs to be filed, it shall be transferred to the competent authorities such as the procuratorial organs for handling in accordance with the law.

For those suspected of committing crimes discovered by inspectors, they shall be transferred to the supervisory or judicial organs for lawful handling in accordance with relevant regulations.

06 Rectification Implementation

The inspected object shall formulate an inspection and rectification plan in accordance with the inspection report, and report it to the Party Central Committee and the State Council within the prescribed time limit.  

The inspected object shall carry out the rectification work in accordance with the requirements of the rectification plan, and report the implementation of the rectification to the Party Central Committee and the State Council within the prescribed time limit.

The Central Ecological Environment Protection Supervision Office shall carry out dispatch and supervision of the implementation of rectification and inspection, and organize spot checks and verifications. For those who fail to rectify effectively, measures such as letters, notifications, interviews, and special inspections will be taken depending on the situation to solidify responsibilities and promote rectification.

The inspection team also needs to strengthen the work of supervising and reforming at the same time. For ecological and environmental issues reported by the people during the inspection process, as well as other issues assigned by the inspection team, the inspected objects should make immediate and resolute corrections to ensure that the relevant issues are investigated and rectified properly.
