In order to thoroughly implement the "Opinions of the Central Committee of the Communist Party of China and the State Council on Deepening the Battle of Pollution Prevention and Control" and continue to maintain a high-pressure situation in cracking down on environmental illegal crimes, recently, the Ministry of Ecology and Environment, the Supreme People's Procuratorate, and the Ministry of Public Security (hereinafter referred to as the three departments) jointly issued a notice to continue the special action of deepening the crackdown on hazardous waste environmental illegal crimes and key pollutant discharge units' automatic monitoring data falsification illegal crimes nationwide, and made comprehensive arrangements for the work focus, tasks, and guarantee measures of the special action.

Since 2020, the three departments have organized two consecutive special actions to crack down on illegal and criminal activities related to hazardous waste environment. In 2021, cracking down on key polluting units that falsify automatic monitoring data and commit environmental crimes will be included in the special action for that year. By continuously cracking down on hazardous waste environmental illegal and criminal activities, the high incidence of related environmental illegal and criminal activities has been curbed, especially with significant results from the special action in 2021. Firstly, the intensity of the crackdown has significantly increased. The penalty amount for cases involving hazardous waste in the 2021 special action is 2.7 times that of the previous year. The number of cases involving hazardous waste handled in provinces (cities) such as Tianjin, Zhejiang, Fujian, Shandong, and Yunnan has doubled. The number of illegal cases involving automatic monitoring investigated and dealt with in various regions has reached a record high in recent years. Secondly, the effectiveness of joint law enforcement has significantly improved. A total of 23 provinces (cities, districts) across the country have signed 12 (including 7 in 2021) cross regional joint prevention and control or joint law enforcement mechanisms or agreements related to hazardous waste environments, and coordinated the handling of 116 illegal cases involving hazardous waste across provincial administrative regions. Ecological and environmental departments in various regions have upgraded and handled 114 major cases, and some regions have jointly handled 55 cases of environmental violations involving hazardous waste with transportation, market supervision, maritime police and other departments. The third is the continuous optimization of regulatory and law enforcement services. The Ministry of Ecology and Environment promotes the establishment of cross regional joint prevention, control, and law enforcement mechanisms, introduces measures for identifying and managing hazardous waste, and simplifies the approval procedures for cross provincial transfer of hazardous waste; Carry out pilot applications of automatic monitoring data for pollutant emissions in key industries, guide and assist enterprises in improving automatic monitoring and management of pollution sources. The procuratorial organs adhere to the principle of equal emphasis on cracking down on and repairing, extend their prosecutorial functions, practice the concept of restorative justice, and actively urge violators to repair the damaged ecological environment.

The notice clarifies two key areas of work, one is to crack down on illegal collection, storage, utilization, and disposal of hazardous waste by units without a hazardous waste operation license or using legal qualifications as a cover; Knowing that others do not have a hazardous waste management license, providing or entrusting them to collect, store, utilize, and dispose of hazardous waste; Illegal discharge, dumping, and disposal of hazardous waste exceeding 3 tons; Violating the Regulations on the Management of Hazardous Waste Transfer by illegally transferring, discharging, dumping, or disposing of hazardous waste across administrative regions; Concealing hazardous waste as intermediate products, by-products, illegal transfer, utilization, and disposal of hazardous waste and other environmental violations. The second is to maintain strict investigation into illegal activities of automatic monitoring equipment that operates abnormally; Focus on cracking down on environmental illegal and criminal activities such as tampering, forging automatic monitoring data, or interfering with automatic monitoring facilities; Conduct extended inspections on third-party monitoring units that issue comparative monitoring reports in illegal cases, and strictly investigate and punish environmental related illegal and criminal activities that provide false certification documents or issue certification documents with significant inaccuracies in accordance with the law.

The notice proposes three work tasks. One is to strengthen information technology means and accurately discover clues of illegal and criminal activities. Ecological and environmental departments in various regions should conduct in-depth investigations of clues, sort out identified problems, and strengthen information sharing between daily law enforcement and public security organs. They should use big data methods to timely discover illegal and criminal clues and carry out investigations. The second is to implement law enforcement linkage and consolidate the joint efforts to crack down on illegal and criminal activities. Each region's three departments should fully utilize their respective professional functions, work together, and establish a case consultation mechanism; Continue to promote the signing and implementation of a joint law enforcement mechanism for hazardous waste, strengthen joint law enforcement, special case management, and higher-level investigation of key cases such as cross administrative illegal crimes. The third is to improve the case handling system and effectively enhance the ability and level of case handling. Ecological environment law enforcement personnel and public security investigation personnel need to strengthen investigation and inspection, adhere to deep digging and expanding the line, insist on investigating the beginning, end, middle, and upstream, middle, and downstream together, trace the source and dig deep along the line, and resolutely cut off the illegal interest chain. We should pay attention to case summary, carefully analyze the characteristics of environmental illegal and criminal cases involved in special actions, carry out typical case analysis, organize practical training, case training, and classification guidance work, and continuously improve the case handling ability of frontline law enforcement personnel.

The notice requires all regions to formulate and refine work plans based on local industrial structure, common illegal issues, etc., highlight key points, and mobilize and deploy widely. Public security organs in various regions should organically link the crackdown activities with the "Kunlun 2022" special action and promote them as a whole. At the same time, we will strengthen publicity and guidance work, expose typical cases of environmental illegal crimes discovered in special operations, and enhance the role of vigilance and deterrence; Further improve the reward and whistleblower protection mechanism for reporting illegal transfer, dumping, and falsification of automatic monitoring data of hazardous waste, and include them in the key reward scope. In the special action, it is necessary to strengthen guidance and assistance to enterprises, increase publicity of environmental protection laws and regulations, effectively enhance the legal awareness and ecological environment protection awareness of enterprises, and implement positive incentive measures.
